1. About These Terms

These Terms of Service govern your use of the Maritrek website and any purchases made through our online store.

Throughout these terms, “Maritrek”, “we”, “us” and “our” refer to:

By accessing our website or placing an order, you agree to these terms. Please read them before making a purchase.

2. Eligibility to Purchase

You must be at least 18 years old, or have permission from a parent or legal guardian, to place an order through our store.

You agree that the information you provide when ordering is accurate, current and complete.

3. Products and Product Information

We make reasonable efforts to ensure that product descriptions, photographs, measurements, specifications and prices are accurate.

Product colours may appear slightly different depending on your screen and lighting conditions. Minor manufacturing differences may also occur, but products will remain consistent with their description.

Measurements and sizing information should be checked carefully before ordering, particularly for fitted products such as wetsuits and clothing.

We may update, discontinue or change products without notice. This will not affect orders that we have already accepted.

4. Third-Party Fulfilment Partners

Maritrek may use third-party suppliers, warehouses, manufacturers and fulfilment partners to store, pack and deliver products.

Products may therefore be dispatched from a different location from our business address, including from a UK or overseas warehouse. This may also mean that items within the same order arrive in separate parcels.

Your purchase contract remains with Maritrek. Our use of a third-party supplier does not reduce your rights against us and does not require you to resolve an order problem directly with the supplier.

Questions, complaints, cancellations, returns and refund requests should be sent to Maritrek using the contact details in these terms.

5. Orders

When you submit an order, you are making an offer to purchase the selected products.

Receiving an automated order confirmation does not necessarily mean that we have accepted the order. It confirms that we have received it.

An order is accepted when it has been approved for fulfilment or dispatched, at which point a contract is formed between you and Maritrek.

We may refuse or cancel an order before dispatch where:

• A product is unavailable

• There has been an obvious pricing or listing error

• Payment cannot be authorised

• The delivery address is incomplete or unsupported

• We reasonably suspect fraud or unauthorised payment

• The order would breach applicable law

If we cancel an order after payment has been taken, we will issue a full refund to the original payment method.

6. Prices and Payment

Prices are displayed in the currency shown on the website.

The total cost of your order, including applicable taxes and delivery charges, will be displayed before you complete payment.

Where import duties, customs charges or similar fees may be payable by the customer, this will be made clear before the order is placed.

Payment must be successfully authorised before an order can be processed.

Payments are handled through Shopify and its approved payment providers. Maritrek does not directly store complete payment card details.

7. Discounts and Promotions

Discount codes must be entered before completing checkout and cannot normally be applied retrospectively.

Unless stated otherwise:

• Only one discount code may be used per order

• Discount codes have no cash value

• Promotions cannot be transferred or resold

• Promotions may have product, location or time restrictions

We may withdraw or correct a promotion where it contains an obvious error. This will not affect orders that have already been accepted.

8. Shipping and Delivery

Available delivery options, estimated delivery times and delivery charges will be displayed on the website or at checkout.

Delivery estimates are not guaranteed delivery dates unless we explicitly state otherwise.

Unless a different delivery period has been agreed with you, orders will be delivered within 30 days.

Because we may use different fulfilment locations, products in one order may arrive separately and may have different tracking numbers.

You are responsible for providing a complete and accurate delivery address. Contact us immediately if you notice an error. We cannot guarantee that an address can be changed after fulfilment has begun.

If an order is delayed, lost or returned to the sender, please contact Maritrek. We will investigate the matter with the fulfilment partner or delivery company and provide an appropriate resolution.

9. Cancellations, Returns and Refunds

Your rights to cancel an order, return products and request a refund are explained in our Returns and Refund Policy, which forms part of these terms.

Please contact Maritrek before returning any product. Do not return products directly to a supplier, manufacturer or an address printed on the parcel unless we have instructed you to do so.

Nothing in our Returns and Refund Policy affects your statutory rights.

10. Faulty, Damaged or Incorrect Products

Products must be of satisfactory quality, fit for their intended purpose and consistent with their description.

If you receive a faulty, damaged, incomplete or incorrect product, contact us with your order number and details of the problem. Photographs or video may help us investigate the issue more quickly.

Depending on the circumstances and your legal rights, we may provide a repair, replacement, price reduction or refund.

Our supplier’s individual refund policy does not limit Maritrek’s obligations to you.

11. Product Use and Safety

You are responsible for reading and following all product instructions, care instructions, sizing information and safety warnings.

Water sports, surfing, swimming, diving and other outdoor activities can involve inherent risks. Products sold by Maritrek do not eliminate the need for appropriate skills, supervision, precautions or safety equipment.

Nothing in these terms excludes liability where excluding it would be unlawful, including liability for death or personal injury caused by our negligence.

12. Website Availability

We aim to keep the website accurate and available, but we cannot guarantee that it will always operate without interruptions, delays or technical errors.

We may temporarily restrict access for maintenance, security, updates or circumstances beyond our reasonable control.

13. Acceptable Use

You must not use the website:

• For unlawful or fraudulent purposes

• To transmit malicious software or harmful code

• To interfere with the website’s security or operation

• To collect information about other users without permission

• To impersonate another person

• To submit false payment or delivery information

• To reproduce or exploit website content without permission

We may restrict access to the website where we reasonably believe these terms have been breached.

14. Intellectual Property

The Maritrek name, branding, website design, written content, graphics and original photographs are owned by or licensed to Maritrek.

You may access the website for personal, non-commercial use. You may not reproduce, distribute, sell or commercially exploit our content without written permission.

Product names, photographs and trademarks belonging to manufacturers or other third parties remain the property of their respective owners.

15. Reviews and Customer Content

Where you submit a review, photograph or other content, you confirm that:

• It is accurate and based on your genuine experience

• You have the right to submit it

• It does not infringe another person’s rights

• It is not unlawful, threatening, abusive or misleading

You give Maritrek permission to display and reproduce that content for operating and promoting the store. We will not falsely alter the meaning of a customer review.

We may remove content that breaches these terms or applicable law.

16. Liability

We are responsible for losses that are a foreseeable result of our breach of these terms or failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable, losses caused by information you provided incorrectly, or business losses arising from products purchased primarily for commercial use.

Nothing in these terms excludes or limits liability where doing so would be unlawful or limits your statutory consumer rights.

17. Events Outside Our Control

We are not responsible for delays caused by events outside our reasonable control, such as severe weather, transport disruption, customs delays, industrial action, natural disasters or widespread failures of communication networks.

Where such an event affects your order, we will contact you where reasonably possible and take reasonable steps to minimise the disruption.

This section does not remove any right you may have to cancel an order where delivery is excessively delayed.

18. Privacy

Our collection and use of personal information are explained in our Privacy Policy.

We may share the information required to fulfil an order with Shopify, payment providers, delivery companies and fulfilment partners. This may include your name, delivery address, contact details and the products ordered.

We will only use and share personal information as described in our Privacy Policy and as permitted by applicable law.

19. Changes to These Terms

We may update these terms to reflect changes to our store, products, suppliers, technology or legal obligations.

The terms applying to your purchase will normally be those published when your order was placed.

20. Severability

If any part of these terms is found to be unlawful or unenforceable, the remaining sections will continue to apply.

21. Governing Law

These terms are governed by applicable UK law.

If you live in Scotland or Northern Ireland, you retain any mandatory rights and legal protections available where you live.
